In a powerful, game-changing and detailed 19 July 2024 opinion the International Court of Justice (ICJ) has stated that the Court in responding to the questions posed by the UN General Assembly has concluded that the continued Jewish Israeli presence in the Occupied Palestinian Territory is unlawful, and that all States are obliged to reject the illegality of the Occupation and cannot render aid or assistance to the illegal Jewish Israeli Occupation.
In December 2022 the UN General Assembly voted for a resolution calling on theInternational Court of Justice (ICJ) to give an opinion on the legality of the now 57-year Jewish Israeli occupation of the Occupied Palestinian Territories. The motion was passed 87 to 26 with 53 abstentions. Al Jazeera reported (31 December 2022): “The United Nations General Assembly has passed a resolution calling on the International Court of Justice (ICJ) to give an opinion on the legal consequences of Israel’s illegal occupation of Palestinian territories. The General Assembly voted 87 to 26 with 53 abstentions on the resolution, with Western nations split but with virtually unanimous support in the Islamic world – including among Arab states that have normalised relations with Israel. Russia and China voted in favour of the resolution. Israel, the US and 24 other members – including the United Kingdom and Germany – voted against the resolution, while France was among the 53 nations that abstained. The Hague-based ICJ, also known as the World Court, is the top UN court dealing with disputes between states. Its rulings are binding, though the ICJ has no power to enforce them… The UN General Assembly asked the ICJ to give an advisory opinion on the legal consequences of Israel’s “occupation, settlement and annexation … including measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem, and from its adoption of related discriminatory legislation and measures” [1].
Disgustingly, the newly-elected pro-Apartheid Israel and hence pro-Apartheid Australian Federal Labor Government mis-ruling my country, Australia, joined Apartheid Israel, pro-Apartheid Israel and hence pro-Apartheid America, similarly pro-Apartheid UK and pro-Apartheid and neo-Nazi Germany, in voting No to the UNGA Resolution.
Eminent South Australian barrister and Palestinian human rights advocate, Paul Heywood-Smith SC (an Adelaide Senior Counsel of some 20 years, the initial chairperson of the Australian Friends of Palestine Association, and author of “The Case for Palestine, The Perspective of an Australian Observer”) was highly critical of the cowardly and immoral position adopted by Zionist-perverted and US lackey Australia (15 February 2023): “Surely the Australian people are entitled to an explanation as to why in December last year the government voted against an International Court of Justice advisory opinion on the legality of Israel’s occupation of Palestine. On 30 December a vote was taken in the UN General Assembly whereby the International Court of Justice (ICJ) was requested to give an advisory opinion on the legal consequences of Israel’s “occupation, settlement and annexation … including measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem, and from its adoption of related discriminatory legislation and measures”. Why did Australia vote against it?The resolution was passed by 87 votes in favour to 26 against. There were 53 abstentions. Western nations split, the US, UK, Germany, Canada, and Australia, voted against, whilst Western nations which voted in favour included Ireland, Belgium, Portugal and Slovenia. There was virtually unanimous support for the vote in the Islamic world, including among Arab states that have normalised relations with Israel. On 19 July 2024 the International Court of Justice issued its Advisory Opinion, “Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem. The Court gives its Advisory Opinion and responds to the questions posed by the General Assembly” [3].The key parts of the ICJ Opinion are reproduced below for your information and convenience:
The International Court of Justice (19 July 2024): “The Hague, 19 July 2024. The International Court of Justice has today given its Advisory Opinion in respect of the Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem. It is recalled that, on 30 December 2022, the General Assembly of the United Nations adopted resolution A/RES/77/247 in which, referring to Article 65 of the Statute of the Court, it requested the International Court of Justice to give an advisory opinion on the following questions:
“(a) What are the legal consequences arising from the ongoing violation by Israel of the right of the Palestinian people to self-determination, from its prolonged occupation, settlement and annexation of the Palestinian territory occupied since 1967, including measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem, and from its adoption of related discriminatory legislation and measures?
(b) How do the policies and practices of Israel referred to . . . above affect the legal status of the occupation, and what are the legal consequences that arise for all States and the United Nations from this status?”
In its Advisory Opinion, the Court responds to the questions posed by the General Assembly by concluding that:
the State of Israel’s continued presence in the Occupied Palestinian Territory is unlawful;
the State of Israel is under an obligation to bring to an end its unlawful presence in the Occupied Palestinian Territory as rapidly as possible;
the State of Israel is under an obligation to cease immediately all new settlement activities, and to evacuate all settlers from the Occupied Palestinian Territory;
the State of Israel has the obligation to make reparation for the damage caused to all the natural or legal persons concerned in the Occupied Palestinian Territory;
all States are under an obligation not to recognize as legal the situation arising from the unlawful presence of the State of Israel in the Occupied Palestinian Territory and not to render aid or assistance in maintaining the situation created by the continued presence of the State of Israel in the Occupied Palestinian Territory;
international organizations, including the United Nations, are under an obligation not to recognize as legal the situation arising from the unlawful presence of the State of Israel in the Occupied Palestinian Territory; and
the United Nations, and especially the General Assembly, which requested the opinion, and the Security Council, should consider the precise modalities and further action required to bring to an end as rapidly as possible the unlawful presence of the State of Israel in the Occupied Palestinian Territory.
Reasoning of the Court… The Court then examines the question of the legal consequences arising from Israel’s adoption of related discriminatory legislation and measures (paras. 180-229). It concludes that a broad array of legislation adopted and measures taken by Israel in its capacity as an occupying Power treat Palestinians differently on grounds specified by international law. The Court notes that this differentiation of treatment cannot be justified with reference to reasonable and objective criteria nor to a legitimate public aim. Accordingly, the Court is of the view that the régime of comprehensive restrictions imposed by Israel on Palestinians in the Occupied Palestinian Territory constitutes systemic discrimination based on, inter alia, race, religion or ethnic origin, in violation of Articles 2, paragraph 1, and 26 of the International Covenant on Civil and Political Rights, Article 2, paragraph 2, of the International Covenant on Economic, Social and Cultural Rights, and Article 2 of the International Convention on the Elimination of All Forms of Racial Discrimination” [3].
The ICJ Opinion is of course rejected by the thieving, serial war criminal, International Law-violating, genocidally racist and egregiously mendacious Jewish Israelis who rule Apartheid Israel while being a 47% minority of the Subjects of Apartheid Israel. No doubt pathological liar and populist authoritarian Donald Trump, child-killing geriatric Joe Biden, and the Zionist-subverted West in general will find common ground in supporting Apartheid Israel’s gross violation of International Law in its continuing war criminal Occupation, just as these moral degenerates support the ongoing Gaza Massacre and Gaza Genocide in the Gaza Concentration Camp.
Already the Zionist-perverted US and the Zionist-perverted US lackey West is rejecting the ICJ ruling, with some Mainstream media already claiming that it is “non-binding” [5, 6]. However Al Jazeera thinks otherwise, correctly stating that “Its rulings are binding, though the ICJ has no power to enforce them” [1].
The World can expect a tsunami of International Law-rejecting propaganda from Zionist, pro-Zionist and Jewish Israeli supporters of the Occupation and the century-long ongoing Palestinian Genocide (2 million dead from British- and Zionist-imposed deprivation and scores of thousands violently killed before 7 October 2023). Already the UK Guardian and the Australian ABC (the tax payer-funded Australian equivalent of the racist and mendacious UK BBC) have incorrectly asserted that the ICJ ruling is “non-binding” [5, 6]. Al Jazeera correctly points out that “Its [the ICJ’s] rulings are binding, though the ICJ has no power to enforce them” [1]. Obviously the expert ICJ findings on the illegality of the highly abusive, 57-year Jewish Israeli Occupation are “binding” on all decent people if rejected by serial war criminal neo-Nazi Apartheid Israel and its serial war criminal neo-Nazi US Alliance backers.
The prestigious medical journal The Lancet has estimated that since the 7 October 2023 Palestinian Breakout from the Gaza Concentration Camp over 186,000 Palestinians have been killed through violence and Jewish Israeli-imposed deprivation but anti-Arab anti-Semitic Western Mainstream media and politicians have overwhelmingly “disappeared” these 186,000 deaths in bombed, devastated and starving Gaza [7-11]. Before the 5 July 2024 report in The Lancet that estimated 186,000 Gazan deaths from violence and deprivation [10], it was estimated by Euro-Med Human Rights Monitor that by Day 250 of the Gaza Massacre (7 October 2023-13 May 2024) and including those buried under rubble, 45,000 Gazans had been violently killed so far, with this including 16,000 children, 10,000 women, 19,000 men, 500 health professionals, and 152 courageous, truth-telling journalists) [7].
The Palestinian Genocide is so huge in magnitude that it invites comparisons with WW2 Nazi crimes. Thus the over 2.2 million Palestinian deaths from violence and imposed deprivation in the century-long Palestinian Genocide is of the same order of magnitude as the 5-6 million deaths in the WW2 Jewish Holocaust [12-14]. By Day 250 the 16,000 children killed were 35.6% of the total killed [7]. Further, in the impoverished Global South about 70% of avoidable deaths from deprivation are of under-5 year children [15]. The Lancet estimated 186,000 – 37,000 = 149,000 deaths from deprivation. With this information one can estimate that children killed in Gaza include (a) 0.356 x 37,000 = 13,172 (children killed violently) + (b) 0.356 x 8,000 = 2,848 (children killed and under the rubble) + (c) 0.7 x 149,000 =104,300 (under-5 deaths from deprivation) + (d ) 0.356 x (149,000 – 104,300) = 15,913 (5 years and older child avoidable deaths) = 136,233 or about 136,000 children killed in total or 136,000 x 100/1,500,000 = 9.1% of the 1.5 million Jewish children killed by the Nazis in the WW2 Jewish Holocaust [7].
The rate of killing of children by Zionazi Jewish Israelis in Gaza over 8 months = 136,000 children / 8 months = 17,000 children killed per month, whereas the rate of Nazi German killing of Jewish children in WW2 (74 months) = 1,500,000 children/74 months = 20,270 children killed per month). Nazi is as Nazi does. Terrorism is as terrorism does [7]. In 2021 I published “A shocking list of 52 Zionist- & Apartheid Israeli-Nazi Germany comparisons” [16]. The utterly unforgivable Jewish Israeli mass murder of over 136,000 children in Gaza makes a 53rd shocking comparison.
The ICJ finding has been reported in my country, Australia [5, 6, 17] . The International Law-respecting Australian Greens, former Greens Senator Lidia Thorpe and former Labor Senator Fatima Payman (who has ethically exited Labor over the Labor-backed Occupation and Gaza Genocide) [18] demand adherence to International Law and an end to the criminal Jewish Israeli Occupation. The traitorous, genocidally racist and egregiously mendacious Zionists, the pro-Zionist Australian Labor Government, the fervently Zionist Coalition Opposition and all other MPs (with the exception of the International Law-respecting Australian Greens, former Green Senator Lidia Thorpe and former Labor Senator Fatima Payman) support the unlawful presence of the State of Israel in the Occupied Palestinian Territory – the ICJ ruling means that this support for Apartheid Israel’s illegal Occupation must cease immediately.
The horrendous Palestinian death toll [8-11, 19] is in gross violation of the Convention on the Prevention and Punishment of the Crime of Genocide [19] and horribly violates Articles 55 and 56 of the Fourth Geneva Convention (“Geneva Convention relative to the Protection of Civilian Persons in Time of War”) [20] that unequivocally demand that an Occupier must supply its conquered subjects with life-sustaining food and medical requisites “to the fullest extent of the means available to it” [20]. Apartheid Israel grossly violates about 16 key aspects of International Law, namely (1) the UN Charter, (2) the UN Conventionon the Prevention and Punishment of the Crime of Genocide (UN Genocide Convention), (3) the Rights of the Child Convention (United Nations Convention on the Rights of the Child ), (4) the UN Refugee Convention ( UN Convention Relating to the Status of Refugees), (5) the Geneva Conventions, (6) the International Criminal Court, (7) the Declaration on the Rights of Indigenous People, (8) the International Convention on the Suppression and Punishment of the Crime of Apartheid, (9) the Treaty on the Prohibition of Nuclear Weapons (TPNW), (10) the International Covenant on Civil and Political Rights, (11) numerous UNGA and UNSC Resolutions (12) the Universal Declaration of Human Rights, (13) the International Convention on the Elimination of All Forms of Racial Discrimination, (14) the 1926 Slavery Convention or the Convention to Suppress the Slave Trade and Slavery, (15) the 2015 Paris Climate Agreement [21], and now (16) it has rejected the findings of the International Court of Justice (the World Court) on the illegality of the 57-year Occupation of the Occupied Palestinian Territory [3, 4].
Apartheid Israel has ethnically cleansed about 90% of Palestine and has excluded 5.6 million Occupied Palestinians from all provisions of the Universal Declaration of Human Rights [21-23]. The ICJ has unequivocally demanded an end to the Occupation [3, 4].
The Parliament (Knesset) of democracy-by-genocide Apartheid Israel has overwhelmingly rejected a “2-state solution” that has been the fig-leaf of a shamefully dishonest and pro-Apartheid West for decades, and has also rejected the ICJ decision. Apartheid Israel is telling the World that it “owns” all of Palestine plus parts of Lebanon and Syria. The 7.6 million Indigenous Palestinian Subjects of Apartheid Israel will continue to be subjugated indefinitely by the neo-Nazi Jewish Israel minority “from the river to the sea”. Presently the nearly 15 million mostly impoverished Indigenous Palestinians include 7 million Exiled Palestinians (excluded by the Zionazi settler-colonialists on pain death from the land continuously inhabited by their forebears for over 3,000 years to the very dawn of the Agrarian Revolution in the Fertile Crescent), 5.6 million Occupied Palestinians (excluded for 57 years from all human rights under Jewish Israeli military rule for 57 years, highly abusively confined to ever-dwindling West Bank ghettoes (3.3 million) or to the Gaza Concentration Camp (2.3 million) that has been subject to over 9 months of genocidal devastation in the ancient city of Gaza, in what used to be the biggest Palestinian city but now destroyed with about 200,000 people killed and 2 million homeless and suffering severe, Jewish-Israeli-imposed and deadly lack of water, food, sanitation, medicine, and medical care), and 2.1 million Israeli Palestinians (able to vote but subject to 65 Nazi-style, race based discriminatory laws) [21].
The civilized World is utterly revolted by the Jewish Israeli-imposed Gaza Genocide and the utterly unforgivable mass murder of 136,000 Palestinian children. The civilized World will impose comprehensive Boycotts, Divestment and Sanctions (BDS) upon mother-, women- and child-killing Apartheid Israel and upon all people, parties, companies and countries supporting this mass murdering Zionazi state (notably Gaza Genocide-complicit America, UK, Australia and neo-Nazi Germany that are all variously involved in arming and otherwise assisting Apartheid Israel in its Gaza Genocide). The US and neo-Nazi Germany supply 69% and 30%, respectively, of the weapons to genocidal Apartheid Israel ( the pro-Apartheid UK and pro-Apartheid Australia make smaller but significant contributions to the ongoing Gaza Genocide)[27].
Decent, anti-racist Australians will put Gaza Genocide-complicit Labor last in Australia’s preferential voting system (the Coalition Opposition is even worse but Labor is actually in government Federally and in all states and territories except for Tasmania. The World contains 2 kinds of people, those opposing the mass murder of children, and the utterly unforgivable others. Decent law-abiding Australians will put Labor last in Australia’s compulsory and preferential voting system (the Coalition is even worse but International Law-violating, genocidally racist and egregiously mendacious Labor is actually in government, has trashed Australia’s international reputation, and has made Australia complicit in the Gaza Genocide and other gross violations of International Law) [28, 29].
Words fail to adequately describe the genocidal evil of Labor-backed, Jewish Israeli-ruled Apartheid Israel.There is bestiality, paedophilia and incest and then there is voting for genocidally racist, egregiously mendacious, International Law-violating, war criminal, fervently pro-Apartheid Israel and hence unforgivably pro-Apartheid Labor. Indeed on a per capita basis the rate of killing of Gazans by Jewish Israelis is similar to the rate of killing of Australian prisoners of war by the Japanese in WW2 [30]. Decent anti-racist Australians will put Labor last [31-33].
The ICJ ruling represents a major breakthrough in global decency. The massacre of 69 Africans in the 1960 Sharpeville Massacre led to comprehensive global boycotts and sanctions against Apartheid South Africa, the eventual fall of Apartheid and a secular, democratic and multiracial South Africa by 1994 [15]. The ICJ ruling clears the way for massive global Boycotts, Divestment, and Sanctions (BDS) against Apartheid Israel and all its morally degenerate racist supporters. “End Apartheid Israel, Human Rights Denial, Gaza Massacre, Child Killing, Occupation and Palestinian Genocide” [24-26] means the end of a century of Palestinian suffering, the end of the obscenity of Jewish Israeli Apartheid, and its replacement with a peaceful, non-racist, all human rights for all, economically just, socially just, peaceful, secure, secular, and democratic, one-state Palestine for all its inhabitants, “from the river to the sea” [34].
