Religious Rights of Muslims in Uttar Pradesh abused with criminalisation of mere offering of Namaz

On 19th January, Uttar Pradesh (UP) Police rounded up arrested 4 people, including the village pradhan , and registered an FIR charging  20 unidentified and identified people based on a  case registered by UP police regarding offering Namaz at a private place at Sampant village in Bareilly district. UP police accused these people with ‘disturbing public order and breach of peace.’ Criminalisation of merely offering Namaz at a private place was   a direct abuse of the fundamental right of people mentioned in Article 25, which guarantees the freedom of conscience, the freedom to preach, practice, and propagate religion to all citizens. It constitutes the broader crackdown of the Brahmanical Hindutva fascist BJP-RSS government on minorities to reduce them second-class citizens in India. It manifests stripping the Muslim minorities of fundamental rights enshrined in the Constitution and ascendancy of Hindutva fascism.

Later , 10 More people have been arrested in the Sambhal violence case after 2 months, elevating the number of arrested people in connection with the Sambhal violence to 70, including four women.

In another incident in Sambhal, Irfan, perished in a police custodial murder on Monday, with  the police denying him access to  essential medicines promptly.. Custodial killing and point-blank range encounters, especially of Muslim minorities, are becoming a routine occurrence or feature in Uttar Pradesh governed by Fascist Yogi government

The Committee against State Repression in no uncertain terms condemned the arrests of 10 Muslim people in the Sambhal violence case and 4 people in Bareilly for merely offering namaz at a private place. It also condemned the custodial murder of Irfan in Raisatti police station, Sambhal. It demanded the immediate release of all those arrested in the Sambhal violence case and fabricated Bareilly case and lifting of all criminalisation of Muslim minorities. It also called for democratic and progressive organisations and individuals to unite and organise a resistance struggle against the Brahmanical Hindutva fascist attack on the oppressed and exploited sections of society.


Such events are a testament of Hindutva and Brahmanical fascism simmering at a boiling point and the Muslim community marginalised and criminalised at scale unparalleled. It also demonstrates that no effective organised resistance has been organised by opposition parties or democratic forces to check the merciless communal attacks of the Saffron brigade, with the survival of the Muslims endangered as never before. It is the order of the day for Muslims to targeted by vile propaganda, intense intimidation and mob violence. There is no organisation to protect the rights of the Muslim community.
